This one happened just up the road a mile or so. Another fine example of dumbass Texas mentality. 61 year old Joe Horn heard some noises next door on Thursday afternoon. With a quick look out the window he saw a burglary in process. He dialed 911 to report it. The dispatcher told him to sit tight, the police were on the way. Instead Horn grabbed a 12 gauge shotgun went outside and as the two Hispanics legal immigrants - Miguel Antonio DeJesus, 38, and Diego Ortiz, 30 - were leaving, Horn shot them three times in the chest from a distance of 15 feet, needless to say the two died on the spot. Wow, 15 feet with a 12 gauge! Dead-eye Joe.

Houston Police just last week shot and killed a 15 year old African American boy for pulling a red hair brush, and a few months ago Pasadena police kicked a Hispanic man to death in custody. But killing unarmed Hispanics and African Americans is not just in the scope of the police down here in Dumbass, it's the stuff of heroes for just regular Texans too. In Texas if one can lure a person they don't like (or a person of some color they don't like) onto their property, they can kill them.

Horn was upstairs working at a computer about 2 p.m. when he heard the sound of breaking glass next door. Horn called 911, engaging in a protracted conversation with the dispatcher, who repeatedly advised him to wait inside until police arrived."

Mr. Horn, do not go outside the house. You're going to get yourself shot if you go outside that house with a gun," the dispatcher told Horn at one point.

"You wanna make a bet," Horn responded. "I'm gonna kill them. They're gonna get away."

Despite a concerted effort by the dispatcher to persuade him to let police deal with the break-in, Horn was insistent on trying keep them from getting away.

"I don't want you going outside, Mr. Horn," the dispatcher said.

"Well, here it goes, buddy," Horn said. "You hear the shotgun clicking, and I'm going."

Grand Juries seldom indict these white local heroes down here, but in this case Mr. Horn is in some legal trouble because he was told by the police to not go outside, the burglars were not on his property, and it was not at night. All aspects of Horn not following the rule of law.

Mr. Horn has left town saying he was under stress while the investigation proceeds. As of this time there are a few other issues of interest. Mr. Horn did not know his neighbors who now - five days later - have not been contacted or found. And the police said the burglars had a white bag with a large amount of cash in it. I don't have a big wad of cash around here, do you?

First off, this area is about the most Christian and Republican in the known world. It is where Tom DeLay got over 70% of the vote whenever he ran. Shooting unarmed people of color is not only what Republicans do but also what Jesus would do. JESUS KILLS.

And secondly, these Christian Republicans cry rule of law bloody murder when it comes to plying their intolerance and bigotry to illegal immigrants, White House bjs or what have you, but when it comes to shooting unwhite people in the face, that all goes out the window.

I am sure you can well imagine what the letters to the editors read and what the local talk shows are saying. Cheers and bestowing the highest medal of honor and already there are plans for a big parade on his return.

So if any of yall want to come down here to kill someone in your front yard, keep in mind that they have to be on your property. And if you can only lure them to your neighbors yard make sure it is after dark. Be warned, this does not work well for getting rid of bad spouses. Unless they are unWhite.

Horrifying! Oh - I love how he was allowed to leave TOWN while guilty of murder! In most situations if you're even a person of interest you do not leave the area. If you've flat out shot people you're IN the very close confines of the jail.Too bad old farts like this won't live to see the projected changes in ethnicity, when white will be the minority and people of all colors will be the majority, whether they build a wall or not.

You shouldn't have to first clarify the story with their resident status: "grabbed a 12 gauge shotgun went outside and as the two Hispanics legal immigrants" ... only in Texas does the gray area of murdering someone occur between the range of shooting a man's dog (at the top of the heap) and shooting an undocumented person (at the bottom of the scale)

I would have to call BS on your claims of gun expertiese. Effects of a 12 guage shotgun at 15 feet would depend greatly on the type of load used and the choke (constriction of the barrel). In all cases "blowing the head off" would not occur at that range.

The poor dears. If only they could have gotten away from the mean old nasty, (and stupid), Mr Horn, who is probably a republican. Imagine someone being so mean as to protect the home of a neighbor. I mean, how could he?
Obviously the grand jury will vote to hang him. And of course his victims were black, so they will of course suspend all judgment and common sense and see to it that The Reverend Al Sharpton attends the trial and that Mr Horn will be assumed guilty, tried, and executed as he should.

None of what you said here is correct.

The orders of a 911 dispatcher are not determinative. He won't be in trouble for not obeying the dispatcher. Further, the 911 tape does not incriminate him so much as it will provide for his defense. It goes a long way to supporting the "reasonable belief" standard of the statute. In short, there doesn't have to be an actual burglary, he has to reasonably believe a burglary is imminent or has been committed.

According to Penal Code section 9.43, the perpetrators don't have to be on your property. In fact, the very section is styled, "Protection of Third Person's Property." The prequisiste to invoking section 9.43 is that you would be justified in using force or deadly force for the same circumstances involving your own property.

Finally, the nighttime requirement is only for theft committed on the property (e.g., stealing a bicycle from the front yard) or criminal mischief (e.g., spray painting graffiti on the garage door). There is no nighttime requirement for arson, buglary, robbery or aggravated robbery. In fact, you're not even restricted to a buglary in progress. You can use deadly force to retrieve your neighbor's (and your own) property immediately after commission of the burglary.

While you may not agree with the statute, or with Joe Horn's actions, that's not the same as saying he is criminally liable for his actions.

The Harris County DA likely let him, or told him, to leave the jurisdiction in order to let the political dust settle, because the DA knew that Joe's actions were justifiable under the law and the DA couldn't charge him.

What exactly makes Joe a rasist? Do you know him personally, or do you have some inside information that is about to be published in the news? Or is he a rasist because he is white? Because he lives in Texas? Because he owns a firearm?

As to the second part of that quote - if the law states that a person is allowed to shoot a criminal during the comisson of a crime - then shooting him is exercising the rule of law. If you do not like the law, write your local representative.

First off the right to have a gun... not the NRA idea. That was our founding fathers due to the right to protect our personel property and lives. Yes times have changed but as you can see from crime rates, people haven't.
If you read the gentlemen's comments that did shoot the two, he is not feeling like he is a hero. He is tired of waiting for police to get to the scene, tired of being put in the position of not having protection, and tired of the PC police such as yourself pushing for no one to have any rights. What is so wrong with what this country was built on. Why are you so quick to judge ones mindset. Don't judge that man. You were not there... or were you.

FIRST: I am glad Joe shot the 2 criminals; I too am fed up with crime. BUT, I do not want to see vigilantism take over here in Texas. Joe was wrong in taking the law into his own hands, he would have been better off with a good camera (or video) to photograph the men and the crime to use in court. What people fail to see is the real bad guy here; it’s the lawyers and a system that will allow prisons to have a revolving door or criminals who repeatedly are on probation. How many crimes have been committed while a person was out on bail, probation, or recently released from prison? Why do death row inmates die of old age? We should kill 10 a day, we need the space. As far as the other prisoners clogging up the court system on appeal after appeal and whining about conditions they should be given a gun with 1 bullet on Fridays and let them kill each other, again we need the space. If we took the criminals off the street and KEPT them there I would not need a gun or have to rely on a neighbor to protect me. We have a system that CAN work, demand that it does and plug the loopholes and ridicules plea deals. If we can’t do that…. Shoot ‘em … but be ready to defend your actions!

Mike, there are several issues here and not all of them are related. I understand your frustration with repeat offenders, but unfortunately we can not lock up everyone who commits a crime away forever. Sooner or later they will be out and when they do come out they are as likely as not to be an even more hardened criminal. Perhaps our entire correctional system needs to be reviewed.
But the main point illustrated by the incident is this - when seconds count the police is only minutes away. Joe may have had a choice whether to go out his door or not. Imagine a slightly different situation - the two guys are breaking into your house and you are in your bedroom on the phone dialing 911. Given how things turned out for Joe - do you think cops would get to your house before the two perps get to you in your bedroom?

Big difference! What IF all conditions were exactly the same except the burglars were 12 and 15 years old, would the public opinion be the same?

Sometimes you HAVE to take action because the police are seldom 'just down the street a block or two.' Some crimes like littering shouldn't be met with lethal force; some crimes should be met with lethal force. If you are going to use lethal force you need to know when to use it and when not. I am frustrated that our justice system has 'no teeth' and the criminals know it. The victims often are punished more than the criminals. Having said that: Even if we are in the right we must still use good judgment in EVERY situation. One size doesn’t fit all....

I love how the description says that they were "legal" immigrants, as if this somehow validates them burglarizing someone's house. It absolutely apalls me how all these people keep whining about the burglars. They knew the risks of breaking into someone's house, but yet we are supposed to feel sorry for someone who deliberately breaks the law for personal greed? I have been broke before, but I have never even considered burglarizing someone's house to line my pockets. I'm sorry.. these two got what they deserved. I just wish they would have made the mistake of hitting Mr.Horn's residence instead. Then there wouldn't be such an uproar over the legality of it. Maybe it will take someone breaking into your house and stealing your hard earned goods ( like what happened to me when I was 8.. on Christmas Eve ) to wake you up. Or maybe they will hit your house when your family is inside asleep. Either way, the American justice system is a failure. This citizen took it into his own hands and stopped a crime. Maybe those two didn't deserve to die, but two things could have stopped it. The damn police took nearly 8 minutes to actually show up there. I find it hard to believe that there was so much else going on here that an officer couldn't respond quicker. And also, you clearly hear that man tell them not to move before he shoots, and obviously they ignored that. Now, no one knows what really happened outside that house, but I do know that I wish my neighbors had half of the gumption that this man did. If those two had in fact been neighbor's kids (white or otherwise) who simply forgot their keys - or were sneaking out to a party, then in fact Joe would have killed two innocent people and would deserve to be tried and likely convicted. That is the danger you face when you start shooting people.

But these were not neighbor's kids. These were burglars, with criminal records. It sounds like Joe may have acted within the law. Grand Jurry shall determine that.

Its funny how all of the bleeding hearts out there are quick to start pointing the finger of guilt when someone does something like this. I feel for the families of the deceased, however, they would still have their loved ones with them had they not chosen to pass by their free time burglarizing someone's house. It also amazes me how when ever a Caucasian person kills someone that is a minority the issue of hate is brought up. "Aww..he's a white man that killed a Hispanic immigrant who happened to be breaking and entering...damn him.He must be a racist." Yet in a case like the Jena 6, where 6 african american young men ganged up and beat a white student badly enough that he needed medical attention....well....that was blamed on the white kid too...funny how things like that work....Maybe you guys should quit worrying about white racists and instead worry about black or hispanic racists..because there are just as many of those as there are white racists.

I live in Maryland and we had a case somewhat simalar a few years back were a elderly black man was being continually harrassed by black youth.One day they entered his back yard to steal a bike and he shot and killed the youth. He was promptly arrested and eventually sentenced to jail. My question is why was this man allowed to leave town? I know laws in texas are different. But he had his mind made up that he was gonna take the law into his own hands. The call clearly supports that.If this was a black man who killed to white men would he be a hero? Even though these criminals were illegals no one should lose there life over property like the dispatcher told him.

No where in the story have I seen where it says that he shot them in the back (it was in the chest and one in the neck) or that a cop was watching... why would Joe have felt the need to go out there and take matters into his own hands if the cops were there?

If you follow the story you will know the facts as they come out. Initially they were legal Mexican immagrants, then they were blacks, the latest story being reported is 'illegal Columbian immagrants.' Initially the story read shot in the chest and neck, the latest stories indicate both were shot in the back and one had a second shot to the neck. Also, articles just published indicate that a plain clothes police officer arrived just moments before Joe shot the first shot and witnessed all 3 shots. As time goes on facts will emerge and the conclusion to this matter will be based on facts, current law, witnesses, forensic evidence. The courts do not use emotion or name calling in basing dicisions as you have done, well unless you are in California and were on the O J Simpson Jury.... :)

If you weren't there you are at the mercy of the media for your facts. They will all come out eventually...

The only requirement to post on a blog is that you can press the keys on a keyboard, you are NOT required to think or use logic and reason. Most posts are spurred by 'at the moment' emotion and others are spun to promote their agenda. Because these two were 'very dark skinned people' with Spanish sirnames the door is open to playing the 'race card' for blacks and spanish, especially since the shooter was not the same color or sirname. I am surpprised Al Sharpton and Jesse Jackson have not made the scene. When ever there is some shit, the Blueflies always show up! :)

Yourself and maybe a couple of other folks on here have displayed a sense of intelligence... however Rack Jite is the main one that displays a tendency towards idiocy. I also cannot believe that Jesse Jackson or Al Sharpton have not showed up to partake of the frenzy. Maybe it's because the "victims" were not indeed black.

These blogs just serve as way to pass time drinking my morning coffee... and a good laugh!

Jackson, Sharpton, et al seem to be having a difficult time these days.

Racial equity in our society has made such advances that to avoid irrelevancy they are often forced to promote criminals (e.g., Jena Six) or frauds (Tawana Brawley, Crystal Mangum). The days of Rosa Parks are long gone and the race baiters are having a hard time adjusting.

As for Rack Jite and others, I can only hope that their revulsion or fear of our frontier mentality, as the case may be, will reduce the number of criminals and leftist Yankees moving here to victimize Texans.

They should be forced to stew in their own juices, like the cesspool of Detroit or the oppressiveness of the People's Republic of Kaliforneeah.

Maybe if they had to live with the consequences of their choices, they'd grow up and stop creating a nanny state to nipple feed them or breed a criminal underclass.

It is wonderful to have it so eloquently put... the liberals can't seem to attain that vernacular. All they are able to do is spew hateful speech about folks that don't agree with their twisted frame of mind and views. Name calling and word twisting is what they, seem to, prefer to logical, rational thought procession.

I as well enjoy my "frontier" mentality. It's what I have grown up with and it works. Now if we were all allowed to do just what Joe Horn did then there would be a lot less crime. But of course the Dems and Libs wouldn't have much of a voter base if the criminals were done away with. So as you can see we won't ever be able to get rid of the scum that use our tax dollars to be supported while they supplement their "income" with stealing from others.

You reap what you sow.

wow...just want to comment on ur statment about the officer shooting the guy with the hairbrush..how would the oficer know if that wasnt a gun? would you rather him wait untill its to late to find out.. because i wouldnt. if it was a gun and the officer didnt shoot in time nd an inocent bystander was killed you would probably be bad mouthing him about not responding in time...so what can polic do to keep people like you happy? nothing because you dont have any respect for what they do ,obviously.
