Keith Waldenowsky of Milwaukee had a bit - okay more than a bit to drink before finding that the mower wouldn't start Wednesday morning and shooting it. He told police quote, "I can do that, it's my lawn mower and my yard so I can shoot it if I want." It turns out that euthanasia of one's lawn mower is not just between the owner and the machine. Charged with felony possession of a short-barreled shotgun or rifle and misdemeanor disorderly conduct while armed may lead to an $11,000 fine and six years and three months in prison if convicted. On the surface it would seem the conservative leaning Supreme Court would side with Washington DC (as a state) to do as they please, which is what being a conservative is most about; states rights today, states rights tomorrow and states rights forever! (that has a familiar ring I just can't seem to place). But much like the Supreme Court conservatives who in 2000 gave us 8 years of a creepy stupid asshole for president, this too is a very political decision, an example of the conservative court going activist.
This is far reaching, it means cities and states no longer have the constitutional right to control handguns and also states that gun ownership is now an individual right. This means all present gun controls will be contested by the NRA, the Militias, the racist and anti-immigration groups and of course the Bloods and the Cripps. So stock up, the small arms race has begun! Good deals can be had in this economic downturn. Prices are down across the board. The best weapon for the toddler through 12 year old group is the rather short barreled semi automatic .22 long (cartidge) rifle that is available at Walmart for under $100. The issue of course was not child rapists but whether the constitution allows execution of ANY non capital offense other than homicide (spies and traitors not with standing). Kennedy's decision reads well to the intellectual reality rather than the emotional violence we feel in regards to children being raped. One of the jurors, Cindy Bradford, who voted for execution (obviously a Christian) went to the press to say that the 10 to 2 decision to not execute this Hispanic illegal immigrant was because everyone was tired and wanted to go home. Gary Blankenship president of the Houston Police Officers Union said he would lobby the state legislature to rewrite sentencing laws to add Life Without Parole and Isolation. Studies find that most inmates go insane after 6 months of isolation. Which of course is the point of the new law. Talk shows and letters to the editor seem to have all been shouted or penned in large red ALL CAP fonts. This is the stuff of revolution here in Texas... The Great Wall of Texas is proceeding, as are gun sales and carry permits, executions, giving children back to child sexual abusers and what seems an endless stream of patriotic funerals of young men coming home from the other side of the world. Or perhaps just shoot some people on the way..."WARNING ILLEGAL TO CARRY FIREARMS/AMMUNITION INTO MEXICO. PENALTY — PRISON." Torres got lost in El Paso and found himself crossing the Rio Grande into Mexico where he was immediately arrested for weapon trafficking. Presently it is hard for the Mexican government to accept it is just a mistake with all the assassinations of politicians and police going on at present with just these kinds of weapons. First let's just consider extending the crack down at this one school to what police do in African American neighborhoods. This is just one on campus cabal, there are likely dozens more. With each supplying many hundreds of students who support their use by selling down the line, trafficking, felony, hard time. Next let's extrapolate that to all 5000 colleges in America. Are you with me here? Because as I write I am not clear exactly where this is going. For the police it sure would be a cakewalk going from fraternity house, to sorority house, to dorm to off campus housing all in a small area filled with mostly unarmed street-dumb kids. And for the police, searching college girls is like living a Girls Gone Wild video. Think of what a boon it would be to trial lawyers! Expensive trial lawyers all the parents would hire. But even with that and our draconian drug laws we would have 100,000s of white college students going to school at Attica, Folsom and what have you, joining the 2 million predominantly black and Hispanics in our prison system now. What would that do? Would it just be fodder for the old hats to have new people to beat and rape? Or would this leveling out and proximity to the more educated class create more desire and motivation upon those already there to grab hold of the American Dream. I also wonder if like dorms these days, would prisons go coed? This could be something that needs doing! It's easy pickings for the police with far less danger than going down to the 4th ward, it would generate revenues with perhaps millions of new arrests and fines, create more middle class jobs for those not in jail, and reduce the recidivism rate as today's prisoners then reach for that American Dream. When police investigated a northern Kansas City home to investigate a suspected meth lab, they arrested a 21 year old, charging him with three counts of possession of a controlled substance and one of possessing drug paraphernalia – in this instance, the the toad. To be accurate, you need a Sonoran Desert toad often found near the Colorado River. You cannot lick any ol’ toad! Clay County Prosecutor Daniel White said possessing the toad is not illegal, but using it to get high from the venom is. Licking the venom used to be the more common method of obtaining the venom, it is being replaced by smoking it. Either method requires a startled or scared toad. I’m happy to say that Genarlow Wilson is a free man today, 21 years old with a bright future ahead.
Many may have wondered why Genarlow Wilson didn’t take a plea deal like his teen-aged buddies elected to do. All were offered a plea deal which would have reduced their sentences, possibly to time served, and eventually remove the conviction and sex offender status from their records. Genarlow, football hero, honor student, and homecoming king with a bright future, chose the ten year sentence handed down to him while the rest went free.
In case you’re unaware of his crime, in his own words he knows that he did some “idiotic” things, as many teenagers do. Wilson then 17, had consensual sex with his then 15 year old girlfriend, then a felony in GA. After turning down the deal, he chose to serve the full 10 year sentence .While in prison, the crime was reduced to a misdemeanor, but would not be retroactive for him. At the time the Supreme Court voted 4-3 to allow him the two years time served, even the court was calling it “cruel and unusual punishment.” Perhaps the story becoming front page news played some small part in the Court’s decision as well? Why did he choose prison? In his own words, “I wouldn’t be able to stay with my mother because I have a little sister. You know when you’re a sex offender you can’t even be around kids. Basically, I can’t even have kids myself, so what is the point of life?” He said he feels no “negative energy” toward District Attorney.David McDade who fought doggedly against efforts to have Wilson’s sentence reduced, fighting for the full ten years. Nor does he feel animosity toward the prosecutors, saying they were just doing their jobs. While he never wants to see the inside of a prison again, he is amazingly positive. His focus is on the future and college. The experience helped him select a major, Sociology “because I feel I’ve been living my major.” “The new Genarlow Wilson will be more conservative, more alert and more appreciative of the blessings bestowed upon him”, he said. I see a bright future for this young man, and mercifully this miscarriage of justice will be nothing more than a speed bump in his distant past, and maybe a lesson to our law makers and those who enforce those laws. Locking justice's door Texas Court of Criminal Appeals chief justice's unethical, outrageous blocking of a death row appeal merits the most severe legal sanctions. The events of Sept. 25 have put a stain on Texas justice that can only be cleansed by the removal of Chief Justice Sharon Keller from the Texas Court of Criminal Appeals. On that day, Judge Keller let her personal bias in favor of the death penalty trample the right of now-executed prisoner Michael Richard to access the courts and have due process. In doing so, she abdicated her role as the state's chief criminal justice to become its chief executioner. Houston Chronicle Editorial In Texas, Judges and Prosecutors are elected. Here in Harris County (Houston and surrounding area) about 99% of judges are Republicans. Every election cycle they compete with one another in television ads that hit on only one issue. Who will execute the most people for less reason faster than the next Judge. Of course they stick the words "Family Values", "Republican" and "Conservative" between all their joyful bloodlust. The Texas execution chamber is in Huntsville (Waller County) which is just a few miles North of Harris county (Houston). 37% of the executions in the United States are committed in Texas, and 25% of those are sentenced to death from Harris County. Its a SHORT MILE. Thus far the Texas Bar and 130 lawyers (growing everyday) have signed petitions to get our newly Christened Judge Roy Bean off the bench. This is the only option to remove her as the PR she has gained by going so out of her way to execute someone can only get her more votes in Harris County than she got last time. We have executions here about once a week, and not long ago three in one week, The Houston Chronicle pleases the prevailing Texas killer instinct by doing an article on each. They give the three names of the person executed, the pictures of the victim followed by many paragraphs detailing the horror of the crime and most always a quip from the victim's Christian family expressing how much they enjoyed watching the man die. But with this editorial attacking Judge Keller, the Chronicle crossed the line. To compensate the paper has been printing many letters to the editor expressing only the profound respect and love Harris Country residents have for Judge Keller. We are witness to a new American lexicon, Airport Rage. Carol Ann Gotbaum somehow strangled herself after being shackled in a Phoenix Airport prison cell. After some drinking, then being refused boarding for being too late at the gate and after she was refused boarding on the next flight because of a rule that she could not board after a kindly person gave up his seat for her, she got angry, loud and when grabbed fought off security guards. I cannot recall NOT being angry at any airport over the last few years. There for the grace of God go I, or even you... I suppose one way to make the process work better would be the NRA answer to all things, everyone should be well armed everywhere.

Tuesday, October 2. 2007Death Penalty - The Circle Stays UnbrokenI read Moby Dick again recently, cementing my view concerning man’s most devastating foible, revenge. Most misery in the world comes from both personal and collective forms of vengeance. The worst ever experienced was WWII (70 million dead) which began with Germany seeking revenge for WWI, which in turn, began over revenge concerning an assassination and so on. We see it everyday not only in the Middle East and Africa but in the execution chambers across America. We see it these days with a President going to war because, “he tried to kill my Daddy.” One would think that if there were a God he would do something about this most debilitating form of human blood lust. Perhaps he could come on down to Earth (or at least send a representative in his name) to teach us all how awful it all is, that there is a better way. As expected it was a 5 to 4 ruling from the Right to get more guns to more people everywhere AS SOON AS POSSIBLE! As everyone knows, the problem here in America is we just don't have enough guns to go around. 
Justice Anthony Kennedy once again stopped the Right-wing from going off the fascist deep end. In this case Kennedy stopped the creation of the world's largest and busiest execution chamber, the United States.
Here is an example of a Christian. Two robbers entered a convenience store in Houston, one pointed a gun into the clerks face while the other held a knife to his chest, took the money and ran. Ash Hussein the 22 year old clerk grabbed a gun and followed them outside, he shot at the car 4 times to stop them but killed one. "This is a day I'll never forget, I wish it hadn't happened, but it did. Someone died over this, that just makes me feel uneasy." Sayed "Ash" Hussein said who by name and remorse is far more Christian than anyone else in Texas.

Far from the Good Ole Boy town of Pasadena, Texas, John H. White (a 54 year old Black man) was found guilty this week of second-degree manslaughter and is now facing 5 to 15 years in prison for killing Daniel Cicciaro, 17, in an upscale neighborhood of Suffolk County, New York.
"Don't worry about my name, What you better do, you better indict Joe Horn. If you don't, somebody
is going to kill him, and if he goes to prison, he's going to be killed
on the inside. They are waiting on him in prison, and we're waiting on him on the outside." Death threat to Joe Horn received by the Harris County District Attorney's Public Integrity Division.
It is way past time for CNN to sell Lou Dobbs to Fox News where he belongs. I wonder if there is even one Hispanic left in America who has not deleted CNN from the favorites button on their remote. His daily hour 7 days a week may be the highest rated show CNN enjoys besides Larry King, but his all consuming campaign of ethnic cleansing - though very popular with every bigot, racist and racist group in America - is losing CNN credibility as it tries to out fox, FOX. 
Judge Sharon Keller of the Texas Court of Criminal Appeals closed the courts' office promptly at 5pm, just hours before the September 25th scheduled execution of Michael Richard. Keller knew damn well that the lawyers for Richard would be submitting a stay of execution appeal that all eight judges on the court would have been forced to accept in lieu of the previous day's Supreme Court decision to review the Kentucky lethal injection case. The lawyers for Richard were late with the appeal because the net was down. All other states employing lethal injection stopped executions earlier that day. But not here in Dumbass, Texas where the joy of execution is only surpassed by playing with guns.
